Current Practice

Zoe’s practice focuses on insurance advice and litigation.  She manages complex and varied matters for a number of insurers and private clients.

Zoe’s current practice includes:

  • public and product liability;
  • property damage (including recoveries);
  • indemnity disputes; and
  • marine claims.​

Experience

Zoe acts for a number of clients on insurance issues.  Some recent matters she has advised on include:

  • defending a claim brought against an insured by his neighbour for alleged property damage caused by tree encroachment and poisoning.  The plaintiff had claimed damages of over $1.4 million, but was ultimately awarded only $5,000; 
  • defending an insurer against a claim for indemnity in respect of damage from an alleged motor vehicle collision. The claim was defended on the basis that the collision was staged and the claim fraudulent. Zoe uncovered a significant amount of evidence which established fraud, and once this was revealed the claim was withdrawn and the insurer’s costs paid in full; and
  • recovering an equal contribution to moneys paid by an insurer under an industrial special risks policy for damage to warehoused goods pursuant to the principles of double insurance.

Zoe has also had significant experience acting on behalf of a large self-insured asbestos manufacturer in relation to asbestos-related personal injury claims.

Qualifications

Zoe has a Bachelor of Laws (Hons) and a Bachelor of Arts from the University of Melbourne.

Zoe is a member of the Law Institute of Victoria, the Australian Insurance Law Association and the Australian and New Zealand Institute of Insurance and Finance (ANZIIF).  She sits on the ANZIIF Liability Discussion Group Committee.
