Current Practice

Joanna has experience in a wide range of contentious and non-contentious workplace relations matters, including: 

  • advising on employment aspects of corporate transactions, including transfer of business issues; 
  • drafting consultancy, employment and executive service agreements;
  • reviewing and advising on the implementation of employment policies;
  • advising on investigations and disciplinary proceedings against employees;
  • acting for employers in proceedings brought in the Federal Court, Supreme Court of Victoria, County Court of Victoria, anti-discrimination tribunals and Fair Work Australia;
  • advising on a range of discrimination issues, including in relation to the operation of employee incentive plans;
  • reviewing enterprise agreements and advising on the interpretation of provisions of enterprise agreements; and
  • conducting client training on various issues, including managing poor performance and amendments to the Federal workplace relations laws.

Experience

Joanna has advised clients across a diverse range of industries, including financial services, construction, mining and resources, manufacturing and state government.  Examples of Joanna’s recent experience include:

  • acting for an employer in injunction proceedings in the Supreme Court to enforce confidentiality and restraint provisions against a former employee;
  • negotiating a Deed of Release with a senior executive of a listed company, involving Corporations Act executive termination pay issues;
  • acting for an employer in breach of contract proceedings brought by a former senior executive in the Supreme Court; and
  • defending a general protections proceeding in Fair Work Australia.

Qualifications

Joanna has a Masters degree from the University of Oxford, a Legal Practice Diploma from the College of Law, London and has completed further studies at the University of Melbourne in constitutional and administrative law.  Joanna was admitted to practice in England in January 2000 and in Australia in March 2008.

Prior to joining Hall & Wilcox, Joanna was a senior associate at Herbert Geer and Allens Arthur Robinson, a lawyer at Minter Ellison in Sydney, McDermott Will & Emery and Linklaters in London.

Joanna is a member of the Law Institute of Victoria.​
