Current Practice

Jessica has experience in both litigious and non litigious employment and workplace relations matters.

Jessica's current practice includes:

  • advising employers on their obligations under workplace relations laws, most recently the Fair Work Act 2009 (Cth) and its transitional arrangements;
  • preparing industrial agreements and common law employment agreements for employers;
    union demarcation disputes;
  • advising on employment aspects of commercial transactions;
  • advising on the application and operation of awards and modern awards;
  • collaborating with employers on their industrial strategy in the face of a changing industrial relations environment;
  • conducting training for employers on a range of issues, including obligations under the Fair Work Act 2009; managing workplace investigations and managing safety incidents;
  • advising employers on employee disciplinary action and procedural requirements for dismissals and redundancies;
  • advising employers on managing ill and injured workers;
  • assisting employers to develop workplace policies and procedures appropriate for their workplace;
  • achieving mediated outcomes in unfair dismissal, adverse action and discrimination complaints;
  • making interlocutory injunction applications in the Supreme Court to prevent alleged breaches of restraint of trade and misuse of confidential information by former employees;
  • acting for and appearing on behalf of employers in various tribunals and courts in Victoria and Queensland, including the Federal Court of Australia, the Federal Magistrates’ Court, the Victorian Civil and Administrative Tribunal, the Queensland Anti-Discrimination Tribunal and the Australian Industrial Relations Commission and Fair Work Australia; and
  • advising employers on compliance with OHS laws and defending prosecutions under workplace health and safety legislation.

Experience

Jessica advises and acts on behalf of employers in both the public and private sector in a broad range of industries including, higher education, financial and professional services, mining and resources and wholesale and retail trade.  Examples of Jessica’s recent experience include:

  • developing a HR framework for a greensfield employer;
  • managing employment and industrial relations issues arising out of the divestments of assets owned by government owned corporations;
  • advising and assisting public sector entities in managing crime and misconduct investigations and obligations under whistleblower protection legislation;
  • making an application to the Federal Magistrates’ Court to enforce employee obligations under a collective agreement;
  • advising on the award modernisation process under the Fair Work Act 2009 for the higher education and ports sector, including making written submissions on the creation of modern awards for the sector; and
  • providing strategic advice on the management of claims of adverse action, workers’ compensation and discrimination.

Qualifications

Jessica has a Bachelor Laws and Bachelor of Arts from Deakin University.  Jessica was admitted to practice in 2004 and has practiced in both Victoria and Queensland.

Jessica undertook her articles at Hall & Wilcox and then joined the employment team for three years.  She then accepted a role in the human resources and industrial relations team at Minter Ellison working in both Brisbane and Melbourne.  Jessica rejoined Hall & Wilcox as a senior associate in January 2011. 

Jessica is a member of the Law Institute of Victoria.
