Current Practice

James has experience in a broad range of commercial and intellectual property matters including:

  • intellectual property commercialisation matters including technology commercialisation agreements, research and development
  • agreement and intellectual property licensing;
  • advising on trade mark registerability and infringement issues;
  • filing and prosecuting trade mark applications;
  • drafting and advising clients on a range of IT contracts including software licences, platform agreements, software development
  • agreements, hardware maintenance contracts and IT service contracts;
  • drafting and advising on general commercial agreements; and 
  • advising clients on regulatory and statutory compliance issues.

Experience

Recent matters which James has been involved in include:

  • advising Encore Tissue on the licensing, protection and enforcement of its substantial trade mark portfolio;
  • advising Apple and Pear Australia Limited in relation to the ongoing international licensing and commercialisation of a well known trade mark and related plant variety rights;
  • acting for a high profile IT company in relation to the preparation of a complex IT platform agreement;
    advising a major Australian bank on a number of technology contracts;
  • acting for a subsidiary of the Reserve Bank of Australia in relation to a number of matters, including the restructure of its research and development division;
  • advising a Victorian government department on competition law and intellectual property issues in relation to a major commercialisation project;
  • advising a large hydraulics company on a multi-million dollar IT project;
  • acting for a client in relation to the defence of trade mark opposition proceedings in respect of a well known trade mark;    
  • acting for a listed mining company in relation to the sale of its wholly owned subsidiary; and
  • acting for a large US software company in respect of its acquisition of interests in Australia and Thailand.

Qualifications

James has a Bachelor of Laws and a Bachelor of Arts from the University of Queensland.

James is a member of the Law Institute of Victoria, the Intellectual Property Society of Australia and New Zealand (IPSANZ) and the Victorian Society for Computers and the Law.
