Current Practice

Emma has the primary responsibility for the personal and family business succession practice within the Private Clients group at Hall & Wilcox. She has extensive experience in the following:

  • estate planning;
  • trust establishment and ongoing administration;
  • asset protection; and
  • structuring for succession of ownership and control of family businesses.

Experience

Emma receives referrals from a range of sources including investment banks, private banks, top-tier accounting firms and financial advisers. As an acknowledged expert in her field, Emma is regularly asked to present at conferences and seminars for professional bodies and organisations.

Emma’s clients include high net worth individuals, families and family businesses. Recent experience includes:

  • preparing personal testamentary trust wills;
  • review of complex family trusts and unit trusts and preparation of documentation to deal with succession of control;
  • trust interpretation and trust disputes;
  • estate adminstration and estate litigation;
  • advising family businesses in relation to shareholder’s agreement and the preparation of existing business structures for entry of second and third generations into business; and
  • providing succession planning advice to families with a focus on wealth preservation and protection of vulnerable beneficiaries.

Qualifications

Emma has a Bachelor of Laws (Hons) from the University of the West of England, Bristol, England. She was admitted to practice in Victoria in 2006 and became a senior associate in 2006.  Emma is a Family Business Australia Accredited Adviser.

Emma is a member of the Law Institute of Victoria, the Inner Temple (Barristers’ Inn of Court, London), the Society of Trust and Estate Practitioners (STEP) and a Fellow of the Tax Institute of Australia.

Prior to joining Hall & Wilcox, Emma worked as a senior associate and manager for offshore law firm, Ogier in Jersey. There she developed expertise in the areas of trust and estate planning.
