Current Practice

Denita's practice is predominantly in commercial dispute resolution with an emphasis on banking litigation. Her practice includes:

  • banking & finance litigation involving mortgages, charges, guarantees, leases and loan agreements including the Uniform Consumer Credit Code;
  • Victorian recoveries for a nationwide residential mortgage recovery syndicate for a major Australian bank and other lending institutions;
  • enforcement of securities & debt recovery;
  • review of securities;  
  • contractual disputes; and
  • corporate and personal insolvency.

Experience

Denita's clients have included banks (Bendigo and Adelaide Bank, Bank of Melbourne (formerly St George Bank) and Bank of Cyprus Australia), large and small businesses and private individuals.

Denita’s recent experience includes:

  • debt recovery including review and enforcement of securities (commercial and residential);
  • advising banks in relation to their obligations under the Uniform Consumer Credit Code and Code of Banking Practice, issues arising in relation to securities and accounts and general enquiries;
  • defending a Magistrates’ Court claim against a bank for negligence in relation to conduct of accounts/alleged unauthorised withdrawals by a customer’s ex-wife;
  • seeking injunctive relief and advising a bank in relation to misappropriation of bank funds by a former bank staff member including recovery of property owned by former staff member; and
  • dealing with difficult customers and advising generally in relation to customer disputes and Ombudsman’s complaints. 

Qualifications

Denita has a Bachelor of Arts, a Bachelor of Laws and a Graduate Certificate in Legal Practice from the University of Tasmania. She became a senior associate in 2004.

Denita is admitted to practice in NSW, Tasmania and Victoria and is a member of the Law Institute of Victoria.

Prior to joining the firm, Denita was a senior associate at Garland Hawthorn Brahe in Sydney where she developed extensive and diverse experience as a commercial litigator and built a considerable practice in banking litigation which includes debt recovery and enforcement of securities.
