Hall & Wilcox acts for Boost Juice on trade mark win

Leading Melbourne law firm Hall & Wilcox has advised and acted for high profile Australian franchisor, Boost Juice Holdings Pty Ltd (Boost Juice) in respect of its successful opposition to an application by Boost Foods Pty Ltd to remove the trade mark 'BOOST FOOD' from the trade mark register for 'non use'.

Hall & Wilcox partner Ben Hamilton acted for Boost Juice in respect of the opposition to the removal application.  Ben was assisted by Hall & Wilcox Senior Associate, Kristie Piniuta. The hearing was before the Delegate of IP Australia with the decision in favour of Boost Juice handed down on 23 September 2010.

Ben commented: 'The BOOST brand and its related trade marks have a strong and distinctive national presence.  Hall & Wilcox is pleased to have assisted Boost Juice in the defence of one of its registered trade marks.'
