Overview

A key strength of the Hall & Wilcox Taxation group is the size, depth and breadth of expertise, with a number of our partners considered leaders in the field. Our advisers have combined legal and accounting tax expertise, with wide-ranging experience in ‘Big 4’ chartered accounting firms, the State Revenue Office, the Australian Taxation Office and on the Board of Taxation of Australia.

We have the resources to meet the needs of both small-to-medium businesses and large corporations, and to provide advice across the full range of tax issues including:

  • transaction taxes: duties (formerly stamp duties), CGT, rollovers and concessions;
  • indirect tax: goods and services tax (GST), fringe benefits tax;
  • corporate taxation: tax planning and restructuring, mergers, acquisitions and divestments, compliance and governance, due diligence and risk management advice;
  • international taxation: investment structuring – inbound and outbound, transfer pricing, tax treaties and concessions, withholding tax, foreign trusts, foreign tax credits and double tax agreements;
  • land tax: raising objections to SRO assessments and valuations, performing land tax calculations and advising on restructure planning;
  • employment taxes: payroll tax, PAYG and WorkCover issues, determining remuneration calculations, including allowances, commissions, bonuses, superannuation contributions and termination payments; and
  • private client: setting up or administering trusts (including charitable and family), establishing tax-effective financing structures, restructuring projects and major transactions and planning for succession.

Experience

Examples of our experience include: 

  • reviewing and advising on the income tax issues associated with the financing strategies of a large multinational retailer and its associates;
  • advising on the buy out of a major shareholder of a large private investment group, including preservation of the group’s tax losses;
  • advising a large multinational fund manager on the income tax issues for the fund manager and investors of investing in capital protected products;
  • structuring the sale of numerous businesses to permit the vendors’ access to available CGT concessions while giving the purchaser a new, clean acquisition vehicle; 
  • use of selective share buy backs, as an alternative to a share sale, when retiring shareholders from corporate groups; and
  • advising on the roll-up of numerous financial planning businesses to a large "consolidator" of such businesses.
