Our team has advised numerous clients from a wide range of industries on the restraint and confidentiality obligations of former employees and acted for employers where their former employees have breached their restraint and confidentiality obligations. This experience includes:
- advising a publicly listed national insurance company on the enforceability of restraint clauses;
- acting for a manufacturer of plastic bags against a former employee who set up his own business in competition with his employer and operated that business while still employed including using his employer’s confidential information to deal with his employer’s customers; and
- advising on and acting for numerous clients in a wide range of industries including recruitment, manufacturing, tertiary education and retail against former employees in breach of their restraint and/or confidentiality obligations.
