Overview

Our experienced succession planning team can assist both individuals and their businesses with succession issues.

Their extensive trust knowledge and experience also enables it to provide advice in relation to an individual’s entire affairs, both personal and business, and regardless of the entity through which assets are held.

Dealing with succession can be an emotional experience for many people for many and varied reasons and our team is skilled at providing compassionate, diplomatic and practical advice to clients.

A succession plan for a typical client involves preparation of the following documents:

  • testamentary trust Wills;
  • powers of attorney (financial and medical) and guardianship;
  • documents passing control of trusts;
  • letters of wishes; and
  • superannuation death benefit nominations (binding or non-binding).

Experience

In addition, the following issues are considered and advised on when undertaking succession planning:

  • asset protection from both creditors and relationships;
  • guardianship of minor children;
  • the possibility of testator family maintenance claims; and
  • capacity.
