Equal employment opportunity

Overview

Our team focuses on providing best practice compliance advice to clients by developing and assisting with implementing effective policies stipulating appropriate behaviour and working with employers to minimise risk and exposure with regard to complaints or disputes. This includes:

  • drafting and assisting with the formulation and implementation of workplace policies and procedures, including equal opportunity, discrimination, sexual harassment, affirmative action, workplace bullying and complaints handling;
  • customised employee and management training programs;
  • representation before courts and industrial tribunals at state and federal level; and
  • advising on compliance with changes to equal opportunity legislation.

Experience

Our team has advised numerous employers in equal opportunity matters before the Victorian Equal Opportunity & Human Rights Commission, Equal Opportunity Commission of Tasmania, Victorian Civil and Administrative Tribunal, Anti-Discrimination Board of New South Wales, Federal Human Rights & Equal Opportunity Commission and the Federal Court and Federal Magistrates’ Court. These matters generally relate to discrimination on termination of employment and sexual harassment and discrimination in the course of employment. We have also prepared and/or advised on investigation reports for clients on equal opportunity matters.

Examples of our team’s experience include:

  • drafting workplace policies and conducting workplace training on anti-discrimination, equal opportunity, sexual harassment and workplace bullying for numerous clients from a wide range of industries;
  • acting for a statutory corporation in the dairy industry in defending discrimination claims brought in the Victorian Equal Opportunity and Human Rights Commission and the Victorian Civil and Administrative Tribunal;
  • acting for a major bank in discrimination proceedings issued in the Federal Court of Australia;
  • acting for a national debt recovery company in discrimination proceedings issued in the Victorian Civil and Administrative Tribunal;
  • acting for a client involved in the manufacturing, importing and distribution of wood panelling in discrimination proceedings brought in the Anti-Discrimination Board of New South Wales;
  • undertaking workplace investigations into claims of sexual harassment and/or bullying on behalf of clients from a wide range of industries, including the Australian branch of a global risk and business consulting firm and a patent and trademark attorneys firm; and​
  • advising clients from a wide range of industries on specific discrimination and workplace bullying issues.
