OverviewOur Construction team has extensive experience across all construction law related areas including drafting and advising on tender and contractual documentation, project structuring including tax considerations, due diligence and risk allocation on construction and development documentation for financiers, and also providing dispute resolution and dispute avoidance advice on complex delay, disruption and variation claims and a variety of defects, bank guarantee recovery, liquidated damages, and other contractual and negligence claims. ExperienceExamples of our experience in this category include:
- preparing and negotiating all project documentation, including consultancy agreements, construction and large scale engineering agreements for the $250m refurbishment of the CSR Yarraville plant;
- acting for Swire Group in relation to industrial development projects in New South Wales, Queensland, Victoria and Western Australia;
- providing advice to financiers regarding the adequacy of construction and development documentation;
- representing hospitals and aged care operators including Epworth Hospital, Austin Hospital, St Vincent’s Hospital, Regis Group, Healthscope and AMP Aged Care in respect of hospital development and refurbishment projects from minor works ($1m) to major projects ($400m); and
- representing institutional developers including CBus Property, ISPT, Challenger, Australian Unity and AMP in respect of commercial and retail property developments (up to $500m) throughout Australia. This work included preparing and negotiating infrastructure supply contracts and all other project documentation; and
- advising Service Stream in relation to front and back-end construction issues.
