Charitable trusts

Overview

Trends in philanthropy indicate both an increase in the incidence and value of bequests left via Wills, and in “planned giving”, which is the making of significant donations and contributions to charitable causes during one’s lifetime. The motivations that drive people to pursue philanthropic objectives are many and varied, but often arise or are articulated in the context of a person undertaking their estate and succession planning. ​

Hall and Wilcox are well placed to advise clients on the various options available to them to give effect to their philanthropic wishes.
Members of our Private Clients team have extensive experience in various aspects of charitable trusts, in particular the establishment and operation of Private Ancillary Funds (PAF) (previously known as Prescribed Private Funds).​

Experience

We have assisted clients with all legal matters relating to the establishment of PAF’s including drafting of variations to the Model Trust Deed, and obtaining the required ATO consents and authorities.

A number of our partners act as the “Responsible Person” for their client’s PAF.

In addition, one of our partners is a member of the Professional Advisors Committee of a Community Foundation.
