Overview

Despite the best planning and management of building contracts, disputes can, and do, arise. By employing strategic analysis and negotiation strategies, the Commercial Dispute Resolution team at Hall & Wilcox can guide you through the dispute process and advise you on the right steps to take to deliver the best possible outcome.
 
We advise on the full range of issues arising out of building and construction disputes, including claims for delay, security payments, variations, extensions of time and defects. We also provide the following (including both front and back-end construction) services:
 
  • contract structuring/risk allocation advice;
  • contractual negotiations;
  • facilitation of expert appraisals/determinations;
  • representation of builders in licensing proceedings;
  • prospects and procedural options; representation in trade practices disputes relating to building/construction contracts; and
  • representation in litigation, arbitration and mediation proceedings.

Experience

Our team has recently been involved in a number of significant building and construction disputes, which include:
 
  • successfully defended a claim by a head contractor of redevelopment at Mt Scopus College that our client’s air conditioning units were too noisy and not powerful enough;
  • represented client in a Supreme Court dispute in relation to the construction of a show room for Regan Motors Peugeot;
  • successfully represented a steel fabricator in a claim for payment against a counterclaim for $300,000 for damages caused when steel beam dropped on site. Our client recovered almost 100% and the counterclaim was paid by insurance;
  • successfully represented a home owner against the former owner-builders in a hearing in the Victorian Civil and Administrative Tribunal;
  • advised a client in relation to an $11M contract to upgrade an aged-care facility;
  • provided pre-litigation advice regarding rights arising from a $4M electrical works subcontract for a major shopping centre; and
  • advised a client in relation to a $10M contract with Oracle to construct an office fit-out.
